TERMS & CONDITIONS
1. These terms and conditions are not all inclusive.
2. BUYER BEWARE. All item(s) sold “AS IS”, “WHERE IS”, and WITH “ALL FAULTS”. ALL SALES FINAL! NO REFUNDS!
3. PREVIEWS. All merchandise is publicly displayed prior to auction during set preview times. We recommend that each item be examined thoroughly. Internet purchasers are urged to have items inspected by an independent appraiser or a third party consultant. Neither Motley’s nor the consignor makes any warranty or representation with respect to the correctness of the catalog. Prospective bidders are urged to inspect property before bidding to determine condition and whether or not items have been repaired, restored, or damaged. Most of the items described in the catalog have come from estates and have, therefore, been subjected to extensive use. ALL SALES FINAL! No items may be returned for credit; however, items may be resold for the new purchaser at the next available auction.
4. BIDDING. Property will be knocked out to the highest bid. Please bid as early as possible. In the event of duplicate bids, the earliest bid will take precedence. The Auctioneer has the right to refuse any bid not commensurate with the value of the item being sold. The Auctioneer may reject any raise in the bidding which is less than the amount being called for. If any dispute arises after the sale, Motley’s sale records shall be conclusive in all respects. Consignors may not bid on their own property. Pooling or collusive bidding will not be tolerated.
5. Should my bids be successful, I personally guarantee payment for the items purchased according to the terms of the sale and I further understand that Motley’s has the right to pursue the legal means necessary to collect any funds due and that I am liable for any costs incurred in the collection of said funds, to include: storage fees, attorney's fees, court cost, insurance, transportation, rigging, etc. I realize I may need to arrange for additional help for the removal of large pieces. I understand that though I may not have physically examined the items listed on this site, that ALL SALES ARE FINAL, no returns, and I cannot cancel the sale of purchases made at this auction. Although Motley’s makes every effort to execute the bids, I, the undersigned, understand that missed bids due to loss of internet connections during the bidding process are not the responsibility of Motley’s.
6. BUYER’S PREMIUM. A 18% buyer’s premium will be applied to the successful sale price for all bidders. This premium will be added to each and all lots sold in the auction. Please bid accordingly.
7. A $25.00 title fee will be charged for each title. Titles will be mailed 10 business days after full payment.
8. PAYMENT. Payment is due by Monday, September 13 at 4:00 pm. Payment shall be made in the form of cash, company or personal checks will be accepted when accompanied by a letter of guarantee from the bank. MasterCard, Visa, Discover, and wire transfer accepted. All charge cards on file will be charged if not paid in full by 4:00 pm on Monday, September 13.
9. NO TRADING OF AUCTION ITEMS. This means buyers cannot sell any item or part of any lot to anyone else while either party is on the auction premises. No items will be switched between buyers even with both buyers present. Violators face permanent expulsion from the auction premises and all future sales.
10. LOCAL SALES TAX DUE. The Purchaser is required to pay local sales tax on the purchase price and the buyer’s premium. A valid tax exemption form must be submitted at the time of registration if you are tax exempt.
11. REMOVAL. Buyer agrees to remove all purchased property from the auction site on September 14 between 12:00 noon and 6:00 pm. A checkout person will be at the auction site (4900 Lakemere Ct. Richmond, VA 23234) to verify your paid receipt and no funds will be collected at that location. This checkout person will show you the location of your assets within the building but is not a mover and will not assist in loading, so please bring any help you may need to move assets out of the building. Buyer is responsible for any boxes, packing material, hand trucks, or dollies they may need to remove their purchases. Buyer is responsible for any damage done to the building or grounds in the removal of their purchases. Motley's is not responsible for any personal injury or accident incurred by the buyer or representative of the buyer at any time. Buyer must remove the lots in their entirety - if a lot consists of the contents of a room or certain area, the buyer must take all items from that room leaving nothing behind. 12. The undersigned agrees to have full insurance coverage on all equipment and vehicles purchased at this sale and is responsible for any damage in removal of purchases.
